It would be great to live in a world where we can take everyone at their word. However, I think we can all agree that it is good practice to ensure that we "get it in writing." But, did you know that even just your spoken word can create a binding contract under the law?
There are a few fundamental requirements to create a contract. One party must make an offer, the other party must accept the offer, and both sides must agree to do (or sometimes refrain from doing) something. These basics, however, can be interpreted in a lot of different ways. What exactly constitutes an offer, or acceptance of the offer? Can doing nothing be considered acceptance? What if one side doesn't do what they agreed to do? Does the agreement need to be in writing?
